Paidwork Terms of Service
1. BASIC INFORMATION
  1. The Terms of Service define the rules and conditions for the provision of electronic services by Paidwork through the Platform, especially the rules and conditions for Users to use the Platform.
  2. Paidwork, through its online Platform, provides Users with various opportunities to earn money by performing simple tasks, such as watching videos, filling out surveys, or playing games. The Platform also enables its business Partners to advertise products or services to a wide audience, providing access to its online service through the website www.paidwork.com and the associated Paidwork software available on mobile devices or other computer devices.
  3. The use of the Platform depends on the acceptance and compliance with these Terms of Service, which apply to all activities carried out through the Service.
  4. The withdrawal of funds by Paidwork to the User’s account is possible upon the User’s completion of tasks provided on the Platform in accordance with these terms and reaching the Payment Threshold.
  5. The Terms of Service are available free of charge through the website www.paidwork.com, allowing anyone to reproduce, record, and print them at any time. The Terms of Service are also provided to the User during Registration, allowing them to review and save it. During the validity of the Terms of Service, the User has the right to request access to its provisions on a durable medium at any time.
  6. Matters not regulated by the Terms of Service are subject to the provisions of Polish law, without prejudice to the absolutely applicable law of the country in which the User has their habitual residence.
2. DEFINITIONS
Points Register A list of points earned by Users for completing Tasks, indicating estimated earnings and balance.
Intermediary Institution A payment service provider maintaining an account for the User, including banks or payment institutions such as PayPal.
User Account / Account A component of the Paidwork Platform with a set of IT solutions allowing the identification of the User within the Platform and enabling the use of services provided within the Platform by logged-in Users.

Partner A business partner of Paidwork, delivering advertising content to Users on the Platform in the form of Tasks.
PayPal An online payment system organized and provided by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
Platform / Platform Paidwork A set of procedures, infrastructure, and relationships with external suppliers organized by Paidwork enabling the provision of the Paidwork service. Users have the opportunity to monetize their online activities under conditions specified by external providers who offer compensation for specific tasks. The Platform is operated by Paidwork and is available as a web or mobile application on iOS/Android devices.
Payment Threshold The minimum level of User earnings, amounting to 10 USD (ten dollars) or its equivalent. Upon reaching this threshold, the User can request a withdrawal of funds to their account.
Point A unit of settlement awarded to the User in exchange for performing Tasks on the Platform
Terms of Service This document – Conditions of Service Provision for Paidwork Users.
Registration A one-time activity involving the creation of a User Account on the Paidwork Platform and filling in the required fields.
GDPR General Data Protection Regulation – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC.
User An individual consumer who is at least 18 years old, possesses full legal capacity, has registered on the Paidwork Platform, and uses or expresses a desire to use it.
Underage User An individual who has reached the age of 15 and uses Paidwork services under a sub-account created by their legal representative, who is a User.
Verification Identity verification of the User based on the Regulations using a document chosen by the User, such as a passport, ID card, or driver’s license, to confirm the User’s declared country of residence.
Tasks Actions provided to the User on the Platform by Partners through which Paidwork enables Users to monetize their online activities.
Withdrawal Request (Funds Withdrawal) A User’s statement to Paidwork via the Platform containing instructions for withdrawing funds visible in the Points Register.
3. ACCOUNT REGISTRATION
  1. To use the Platform, correct and complete User Registration is a prerequisite, equivalent to entering into an agreement in accordance with the provisions of the Regulations. Registration is synonymous with accepting the Regulations; therefore, before declaring acceptance, it is essential to thoroughly familiarize oneself with its contents. Paidwork provides the User with the Regulations on its website and in the Registration process on a durable medium.
  2. After completing Registration and Verification, a User who is a parent or legal guardian has the option to open a sub-account for an Underage User. The User is responsible for all actions taken within the Paidwork Platform by the Underage User. The Underage User can engage in activities provided by external Partners only with the User’s consent, unless the Partner specifies stricter rules. Benefits from the activities of the Underage User are visible in the User’s Points Register.
  3. The User is obligated to securely store and not disclose the login and login password to third parties. The User must promptly report any unauthorized access or use of the User Account to Paidwork. Reports should be made by sending relevant information to the email address: [email protected].
  4. Paidwork may impose additional requirements regarding the security level of the access password, especially its complexity and validity period.
  5. User login occurs by authenticating the User through a web browser or mobile application and providing the correct login and access password.
4. USING PLATFORM FUNCTIONALITY
  1. After a proper Registration and Account Verification, the User gains access to the following Tasks for monetizing their activity: a) playing games b) filling out surveys c) watching videos d) online shopping e) microtasks. Before starting each Task, the User is informed about the estimated number of Points that can be earned for completing the Task. For some Tasks, the User may be redirected to the Partner’s website for proper completion.
  2. Access to the history of completed fund withdrawals and information about the current balance of funds in the Points Register is available after logging into the User Account.
  3. Funds accumulated for completing Tasks are not subject to interest and do not provide any other benefits to the User.
  4. Withdrawal of funds is possible only after reaching the Payment Threshold and providing correct details about the User’s payment account held by the Intermediary Institution.
  5. Once all the conditions described in the Regulations are met, the Withdrawal Request becomes effective. In case multiple circumstances are necessary, the effectiveness of the Withdrawal Request is the moment when Paidwork received the Request and is obligated to fulfill it. After successfully submitting the Withdrawal Request, Paidwork provides the User, upon request, with precise information regarding: a) the maximum timeframe for completing the fund withdrawal, b) fees due from the User, including the breakdown of these fees.
  6. Fund withdrawal to the User’s account held by the Intermediary Institution is only possible in USD unless the User has a PayPal account – in which case withdrawal is possible in the currency chosen by the User and supported by PayPal at their prevailing exchange rate. If the User has an account in a currency other than USD, additional fees may apply, including those related to currency conversion, imposed by intermediary banks.
  7. In exceptional circumstances, Paidwork reserves the right to additional User identity Verification and additional confirmation of the submitted Withdrawal Request.
  8. The execution of the fund withdrawal occurs by crediting the User’s payment account held by the Intermediary Institution specified by the User.
  9. Paidwork reserves the right to refuse the execution of the Withdrawal Request, especially if: a) the request was not properly authorized or there are irregularities, including deficiencies preventing its fulfillment, b) there is a reasonable suspicion that the Request violates legal regulations, rules of fair trade, or the provisions of the Regulations.
  10. Paidwork is entitled to temporarily block access to the User Account and suspend the possibility of exchanging Points for funds in the case of: a) suspicion of unauthorized use of the Account, b) the need for additional Verification, c) a relevant decision by authorized authorities.
  11. The User will be notified by email about the temporary blocking of the Paidwork Account unless providing information about the temporary blocking is unjustified for security reasons or prohibited by law.
  12. Paidwork may temporarily limit the User’s access to the Paidwork Account if necessary to ensure the security of Points acquired by the User or due to Paidwork’s legal obligations.
5. PAIDWORK'S LIABILITY
  1. Paidwork is responsible to the User for non-execution or improper execution of the exchange of Points for funds, excluding cases when: a) non-execution or improper execution of the exchange of Points for funds resulted from force majeure, or if the non-execution or improper execution of the Withdrawal Request results from other legal provisions; b) Paidwork proves that the payment recipient’s settlement account was credited.
  2. If Paidwork is liable for non-execution or improper execution of the exchange of Points for funds, it restores the User’s Points Register to the state it would be in if the non-execution or improper execution of the Withdrawal Request had not occurred.
  3. Paidwork is not liable for the non-fulfillment of services, cases of suspending the execution of a Request, blocking the User Account, or freezing of assets if these actions were taken as part of fulfilling obligations arising from legal provisions.
  4. Paidwork is not liable for the lack of access to the Paidwork Account due to reasons beyond its control. For security reasons, Paidwork has the right to block or temporarily suspend access to the User Account for the time necessary to eliminate existing threats or irregularities.
  5. Subject to the limitations imposed by the mandatory provisions of the law, Paidwork is not responsible for damages arising from the use of the Paidwork Account or the inability to use it by the User, as well as in connection with improper operation, errors, deficiencies, disruptions, defects, delays in operation or data transmission, computer viruses, line failure, or information system failure.
6. TERMINATION OF THE SERVICE AGREEMENT WITHIN THE PLATFORM
  1. The agreement is concluded for an indefinite period. The User may terminate the service agreement at any time with immediate effect, without incurring additional costs.
  2. Termination of the agreement is possible by deleting the Account (functionality available after logging into the Platform). Before deleting the Account, it is necessary to instruct the withdrawal of the accumulated funds in full to the User’s account held by the Intermediary Institution, under the risk of their loss. After the User’s Account is deleted, Paidwork sends a confirmation of the termination of the agreement and the closure of the User’s Account to the User’s email address.
  3. Paidwork has the right to terminate the agreement with at least a two-month notice period.
7. WITHDRAWAL FROM THE AGREEMENT
  1. The User has the right to withdraw from the agreement without stating a reason within 14 days from the date of its conclusion, by submitting a written withdrawal statement to the email address: [email protected]. Sending the statement before the expiration of the period mentioned in the preceding sentence is sufficient to meet this deadline. If consent is given to commence the service before the expiry of the aforementioned period, the right to withdraw from the agreement is not applicable.
  2. Commencement of the service refers to the initiation of monetization through the Platform by the User, involving activities required by external providers and reaching the Payment Threshold.
  3. The template for the withdrawal statement is attached as Annex 1 to the Regulations.
8. AMENDMENT OF THE AGREEMENT
  1. Paidwork reserves the right to make changes to the content of the Regulations in the event of significant reasons, which include: a) changes in the scope, form, functionality, or support of the offered services, b) changes in legal regulations that may affect the provision of services by Paidwork or User support, c) the need to adapt the Regulations to the applicable local legal regulations or other relevant regulations concerning the countries in which Paidwork provides services, d) the need to adjust the Regulations to consumer protection requirements, e) issuance of guidelines, recommendations, decisions, recommendations, or court judgments affecting the mutual rights and obligations of the parties to the agreement, f) the need to improve the security or availability of the provided services, g) changes in the scope of business conducted or changes in the scope of services provided or the method of service provision, h) introduction of new products or services to Paidwork’s offer or changes to Paidwork’s offer involving the modification of services or products, including their scope and method of provision, i) the need to adjust the Regulations to market conditions, j) changes in tax regulations or accounting principles applied by Paidwork to the extent that these changes affect the content of the agreement concluded based on the Regulations, k) the need to clarify or update the provisions of the Regulations.
  2. The User will be informed by Paidwork about the changes through an electronic message sent to the email address provided by the User and through a notification displayed on the User’s Account.
  3. The changes come into effect on the date indicated by Paidwork, which cannot be less than 2 months from the date of electronic notification about the amended provisions of the Regulations. In the absence of the User’s objection to the introduced changes, it is equivalent to consenting to them. If the User objects but does not terminate the agreement, the agreement expires on the day preceding the effective date of the proposed changes without incurring any fees.
  4. The User has the right to terminate the agreement free of charge before the proposed changes take effect, with effect from the day the User is informed of the change, but no later than the day the changes would take effect.
  5. The previous provisions apply to Orders placed by the User before the effective date of the changes.
9. COMMUNICATION BETWEEN THE USER AND PAIDWORK
  1. Paidwork directs notifications to the User: a) through the Platform, displaying information in a way that allows them to become acquainted with its content, b) via email to the email address specified on the User’s Account.
  2. The User can communicate with Paidwork through the email address [email protected], the contact form at https://www.paidwork.com/contact-us, or traditional mail to Paidwork’s registered address.
  3. Transmission and submission of reports are possible only if the technical requirements specified in the Regulations are met.
  4. Paidwork employs a secure procedure for notifying the User in the event of fraud, suspected fraud, or security threats. For this purpose, Paidwork verifies whether, after detecting fraud, suspected fraud, or security threats, the User has not lost the ability to safely use the email address provided during Registration and notifies electronically using that email address. In case of any doubts about the possibility of secure contact with the User through the indicated email address, Paidwork takes appropriate measures to establish direct contact with the User through other channels, including traditional mail. In the event of a phone call with the User, Paidwork reserves the right to verify the identity of the caller.
10. TECHNICAL REQUIREMENTS
  1. To use the Platform, the User must meet at least the following technical requirements: a) have a computer or mobile device capable of browsing websites and installing mobile applications, b) have access to the Internet, c) possess a phone capable of receiving SMS messages or phone calls, d) have an email address, e) have access to websites through a properly configured web browser.
  2. In fulfilling the obligations arising from the Act on the Provision of Electronic Services, Paidwork informs that using the Internet involves risks, including but not limited to spyware, computer viruses, and SPAM (unsolicited commercial information).
  3. Paidwork informs that there are no security measures for computer systems entirely resistant to unauthorized interference by third parties. Despite Paidwork’s proper protection of data provided by Users, using the Platform carries the risk of unauthorized access to this data by third parties. Consequently, there may be unlawful use of this data by those individuals, including sending unsolicited commercial information or installing malicious software on devices or using it for unauthorized privacy violations.
  4. Users using Internet services should ensure the security of their computers or phones. The computer should have antivirus software with an up-to-date virus definition database, a secure version of a web browser, and an active firewall. It is recommended to use tools in the web browser to check whether the displayed website does not aim to obtain information, such as by impersonating a person or institution. When using a home wireless network (WIFI), it is advisable to establish a secure and difficult-to-crack password for network access.
  5. Technical requirements regarding the User’s hardware and software are the same for all Platform functionalities.
11. COMPLAINTS AND CLAIMS, DISPUTE RESOLUTION
  1. Complaints can be submitted: a) in writing – to the address: Paidwork Ltd., Podzamcze 217, 21-010 Podzamcze, or by postal mail, within the meaning of Article 3 point 21 of the Act of November 23, 2012 – Postal Law (Journal of Laws of 2012, item 1529), b)  via email: [email protected].
  2. Paidwork will inform the person who submitted the complaint about the way it is considered – in paper form or using another durable medium of information. Paidwork may also provide a response to the complaint by email – upon the complainant’s request and to the email address provided by them.
  3. Paidwork considers and responds to a submitted complaint within a period not exceeding 14 days from the date of its receipt. In particularly complex cases preventing the consideration of the complaint and the provision of a response within this period, Paidwork will promptly inform the User of the expected deadline for the complaint to be considered, along with stating the reasons for the delay and the circumstances that need to be established to resolve the matter.
  4. The response to the complaint includes, in particular: a) factual and legal justification, unless the complaint has been considered in accordance with the User’s will; b) comprehensive information about Paidwork’s position on the raised objections, including indicating relevant sections of the agreement concluded between Paidwork and the User; c) the name and surname of the person providing the response, along with indicating their official position; d) specifying the deadline by which the claim raised in the complaint considered in accordance with the User’s will shall be fulfilled.
  5. In the event of deeming a specific complaint unfounded, Paidwork does not provide an appeals procedure within its internal complaint resolution process.
  6. Any disputes unresolved amicably may be submitted for resolution to the competent local and material general court.
12. FINAL PROVISIONS
  1. The administrator of Users’ personal data within the meaning of Article 4(7) of the GDPR, provided by them in connection with the conclusion and implementation of the Agreement, is Paidwork.
  2. Polish law is applicable to the framework agreement. Any disputes arising from or related to the Regulations will be resolved by the competent common courts in Poland.
  3. Correspondence, including all notifications, information, and other communications, will be provided in Polish or English.
  4. The User is obliged to promptly inform Paidwork of any changes to their contact details, especially email address, phone number, and mailing address.
